Terms of Use
This document is provided in English, which is its authoritative version. Localized titles and any translations are offered for convenience only; in the event of any discrepancy, the English text prevails.
1. Acceptance of Terms
By accessing or using Proton Bus Mods ("the Site"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site.
2. Nature of the Service
The Site is a fan-operated repository and index that hosts and links to modifications ("mods") created, converted and distributed by third parties and by the modding community, including content sourced from public communities and the public internet. We are not the author, converter or editor of the majority of the content made available. Where the original author or contributor can be identified, credit is attributed to them; the absence of a credit is not a claim of authorship by us. We do not endorse, certify or guarantee any mod.
3. Third-Party Content and Intermediary Status
Content on the Site is largely supplied by third parties. In accordance with the Marco Civil da Internet (Lei nº 12.965/2014, art. 19), as an intermediary we are not liable for third-party content unless we fail to act after a specific judicial order or a valid removal request. We act expeditiously to remove or disable access to content upon receiving a valid notice (see Section 5).
4. Intellectual Property and Trademarks
All game titles, vehicle models, manufacturer names, brand names, liveries, logos and trademarks displayed on the Site (for example, and without limitation, the names of bus, truck and car manufacturers and bus operators) are the property of their respective owners. Proton Bus Mods is an independent fan project and has no affiliation, partnership, sponsorship or endorsement from any game developer, vehicle manufacturer or brand owner. Any such references are nominative and descriptive only, used to identify the subject of a mod. Mods and their assets belong to their respective authors and remain subject to their authors' rights and licenses.
5. Copyright Complaints and Content Removal
We respect intellectual property rights. If you are a rights holder (or their authorized agent) and believe that content on the Site infringes your rights, please contact us at contact@protonbusmods.com with: (a) identification of the work or right concerned; (b) the exact URL(s) of the allegedly infringing content; (c) your contact details; and (d) a statement that you are the rights holder or authorized to act on their behalf. Upon receiving a valid request we will remove or disable the content within a reasonable time. We may also remove content at our discretion and may restrict users who are the subject of repeated valid complaints.
6. Acceptable Use
You agree not to use the Site to upload or distribute malware, to scrape or overload our infrastructure, to violate any law, or to infringe the rights of others. We may suspend access for any user who breaches these Terms.
7. Disclaimer of Warranties
All content, including mods, images and texts, is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, safety, legality, or non-infringement. We do not guarantee that any mod is functional, safe, free of defects or malware, or lawful to use in your jurisdiction. You download and use any file entirely at your own risk and are responsible for scanning files for security before use.
8. Limitation of Liability
To the fullest extent permitted by law, Proton Bus Mods and its operator shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including loss of data or device damage, arising from or related to your use of, or inability to use, the Site or any content or mod obtained through it.
9. Indemnification
You agree to indemnify and hold harmless Proton Bus Mods and its operator from any claim, demand, loss or expense (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any third-party right.
10. External Links and Downloads
The Site links to third-party file hosts and websites which we do not control and are not responsible for. Downloads are delivered by those third parties under their own terms.
11. Changes to These Terms
We may modify these Terms at any time. The effective date below indicates the most recent revision. We recommend reviewing this page periodically; continued use after changes are posted constitutes acceptance.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising from these Terms or the use of the Site shall be submitted to the courts of the operator's domicile in Brazil, to the exclusion of any other, however privileged.
